Chatham GP Babatunde Oshinusi cleared of 15 sex assaults at St Mary's Medical Centre in Stroos to face General Medical Council hearing

A GP cleared of 15 charges of sex assaults on patients at his surgery will face action before the General Medical Council, it has been revealed.

Dr Babatunde Oshinusi, of Tunbury Avenue, Walderslade, Chatham, denied 12 charges of assault by penetration and three of sexual assault before a Maidstone Crown Court jury.

He was alleged to have committed the offences at St Mary’s Medical Centre in Strood, where he was a partner, between 2007 and 2010.

One of the women was aged 81 when she complained that the father-of-two had touched her in a sexual way in 2010 when she went to see him about a bladder problem.

But the jury cleared him of all charges.

Now it has been revealed he is to face action with the medical watchdog, the GMC, over “clinical concerns” associated with his case.

His QC Adrian Darbishire said it was common practice since the GMC introduced a civil standard of proof rather than criminal standard, to prosecute notwithstanding an acquittal.

“He will in all probability find himself defending the same conduct in a tribunal considering the same matters,” said Mr Darbishire. “It will take place in Manchester.”

The QC was responding to Judge Jeremy Carey in asking if “charges had been laid” against the GP by the GMC. “I ask because I am sure the jury would be interested to know,” he added.

Mr Darbishire said the doctor had not worked since his suspension in July 2010 and he would remain suspended until the GMC took a “final approach”.
