MICHAEL STONE, the man convicted of the Russell murders in Kent 10 years ago, has failed to stop publication of a report containing highly personal medical information.

He wanted an edited version of the report published for the press and public to see but in the High Court today Mr Justice Davis said: "I refuse to grant Mr Stone any of the relief he seeks."

However, the report will not be released until Wednesday, July 26, so Stone’s lawyers will have time to ask the Appeal Court to hear the case.

Mr Justice Davis said the public interest required the report to be published in full.

Stone, from Gillingham, was convicted in 2001 of the murders of Lin Russell and her daughter Megan and the attempted murder of her other daughter Josie at Chillenden, near Canterbury, in 1996. He is now serving three life sentences.

Before the killings, Stone had been receiving treatment for mental health problems and drug addiction and an independent inquiry looked at the care he was given.

Stone had asked the High Court to agree that personal information he gave to the inquiry should only be given to professional organisations and not made public. He said he was happy with an edited version being published.

But Kent and Medway Strategic Health Authority, Kent County Council and Kent Probation Board said they wanted publication of the full report, as did Josie Russell and her father Shaun.

Mr Justice Davis said publication would not violate Stone’s right to privacy under the European Convention on Human Rights.
